Terms of Use
These Terms of Use govern access to the Svitlofour websites, web applications and mobile application, together with the related features, materials and services (collectively, the “Service”).
The Service is operated by Svitlofour jednostavno društvo s ograničenom odgovornošću za promidžbu i usluge profesionalne podrške (Svitlofour j.d.o.o.), OIB 56633031613, Deverićeva 4, 10412 Donja Lomnica, Croatia (“Svitlofour”, “we”, “us”).
By using the Service, you confirm that you have read and agree to comply with these Terms. If you do not agree, do not use the Service.
Key points
- Svitlofour helps people create and view location-related Reviews, Reports, comments, media, Observer alerts and Chain histories.
- You are responsible for the legality and accuracy of the content you publish and for having the necessary rights to photos, text and other materials.
- Map data and user publications are provided for information only and do not replace professional, emergency or official information.
- We may restrict or remove illegal or prohibited content and, where required by law, will explain the decision and the available appeal route.
- Paid features, price, billing period, automatic renewal and cancellation method are shown before payment.

1. The Service and its purpose
Svitlofour is a map-first platform for publishing, viewing and analysing location-related signals and context. Depending on the version of the Service and the type of account, users may:
- view the public map and materials connected with locations;
- create Reviews and Reports containing text, photos, location, time, status and hashtags;
- add comments and submit complaints about content;
- configure an Observer by location, radius or hashtag;
- view a Chain as a chronological history of events at one physical place;
- receive notifications;
- use company, employee, reporting and analytics features;
- use free or paid plans.
Some features may be unavailable in a particular country, on a particular device, in a particular application version, or without the required plan or role.
2. Who may use the Service
You may use the Service if you have the legal capacity to enter into a binding agreement under the law applicable to you.
If the law in your country requires parental or guardian consent to use the Service or process personal data, you must obtain that consent. A person prohibited by law from using the Service may not create an account.
If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf.
3. Account and security
Some features require an account. You must:
- provide accurate and current information;
- keep your access credentials confidential;
- not transfer your account to another person without our permission;
- notify us promptly if you suspect unauthorised access;
- remain responsible for activity performed through your account, unless the law provides otherwise.
Sign-in may be handled by a third-party authentication provider. That provider’s own terms and privacy policy apply to your interaction with it.
4. User Content
“User Content” means material that a user uploads, creates or makes available through the Service, including text, Reviews, Reports, comments, photos, videos, location names, hashtags and other information.
You retain your rights in your User Content. You grant Svitlofour a non-exclusive, royalty-free, worldwide licence to store, reproduce, technically adapt, display, distribute and otherwise process that content only to the extent required to operate, secure, moderate, back up, improve and promote the Service. This licence ends when the content is removed from active systems, except where it is lawfully retained in backups or evidence relating to a dispute, or where it has already been lawfully shared by other users.
Public content may be visible to an unlimited audience, shared through links, indexed by search engines or retained by other users. Do not publish information that you do not want to make public.
By publishing content, you confirm that:
- you have the necessary rights, permissions and lawful basis;
- the content does not infringe privacy, copyright, trade mark or other third-party rights;
- people shown in the content have provided any permission required by law;
- the information is not knowingly false, misleading or fabricated;
- publication does not breach the law or any contractual or professional duty.
5. Prohibited use
You must not use the Service for:
- unlawful content or activity;
- threats, harassment, bullying, hate speech or incitement to violence;
- sexual exploitation, particularly involving children;
- publishing another person’s personal, confidential or payment data without a lawful basis;
- defamation, fraud, impersonation or manipulation of reviews;
- infringement of copyright, trade marks or other rights;
- spam, malicious code, automated bulk data collection or circumvention of technical restrictions;
- interference with the security, availability or normal operation of the Service;
- creating a dangerous situation while driving or entering a restricted area;
- using the map or signals as the sole basis for decisions affecting life, health or safety.
6. Location, maps and media
Map features may use the approximate or precise location of your device only after you grant the relevant permission. You can change access in your device or browser settings. Disabling permission may limit certain features.
When creating content, verify the location, time, status and description. Coordinates, addresses, radius boundaries, routes, markers and aggregate values may be inaccurate or update with a delay.
Do not take or publish photographs where this is prohibited, and do not place yourself or anyone else at risk in order to create content.
7. Moderation, notices and illegal content
Users can report content through the complaint mechanism available in the Service or by writing to info@svitlofour.com. A notice should identify the material precisely enough, explain the reason for the complaint and, where illegality is alleged, include the relevant facts and legal basis where reasonably possible.
We may review content and take proportionate measures, including:
- taking no action;
- restricting visibility or functionality;
- adding a warning or correcting a technical display issue;
- removing content;
- temporarily restricting or terminating access to an account;
- retaining material where required by law or necessary to protect rights.
The decision will take account of the nature of the breach, context, repetition, risk of harm, users’ rights and legal requirements. Where applicable, we will explain the reason for the decision and the route for a free internal appeal. An appeal may be submitted to info@svitlofour.com with a link or identifier for the material, a description of the decision and reasons for reconsideration.
We are not required to review all User Content in advance and do not endorse statements made by users.
8. Company features
A company may invite employees, assign roles, create Report types and view related data and analytics. The company administrator is responsible for the legality of invitations, proper role assignment and the lawful basis for processing employee data.
Where a company determines the purpose and means of using personal data through Svitlofour, it may be a separate controller of that data. Svitlofour does not replace the company’s internal policies, employee notices or other legal obligations.
9. Paid plans, payment and renewal
Before a paid plan is purchased, we display the material information, including the plan features, price, currency, taxes, billing period, automatic renewal and method of cancellation. Payment may be processed by a third-party payment provider.
If automatic renewal is selected, the subscription renews at the end of the paid period until cancelled. Cancellation stops future charges, but access will normally continue until the end of the period already paid for.
Withdrawal rights, refunds and mandatory guarantees are governed by the law applicable to the user. Nothing in these Terms limits mandatory consumer rights. Additional payment and cancellation terms shown before purchase form part of these Terms.
10. Svitlofour intellectual property
The Service, software, design, logos, trade marks, database and Svitlofour materials are protected by law. Apart from the limited right to use the Service under these Terms, no rights are transferred to you.
You may not copy, sell, license, modify, decompile or create derivative products from protected elements of the Service except where expressly permitted by law.
11. Third-party services
The Service may use or link to third-party services, including maps, authentication, app stores and payments. We do not control their availability, content or rules. Review the terms and policies of the relevant provider before using it.
12. Availability, changes and discontinuation
We aim to keep the Service operational but do not guarantee uninterrupted or error-free availability. We may change, test, suspend or discontinue features for security, legal, technical development or business reasons.
Where practicable, we will give advance notice of material changes. If a paid feature is discontinued, the user’s refund rights are determined by applicable law and the terms of purchase.
13. Disclaimer of warranties
The Service and User Content are provided “as is” and “as available”. To the extent permitted by law, we do not guarantee that information is complete, accurate, current or suitable for a particular purpose.
Svitlofour is not an emergency service, public authority, medical, legal, security or navigation service. If there is an immediate danger, contact the relevant emergency or competent authority.
14. Limitation of liability
To the extent permitted by law, Svitlofour is not liable for indirect, incidental or consequential loss, or for loss of profit, data or business opportunity arising from use of, or inability to use, the Service.
This limitation does not apply to liability that cannot be excluded by law, including liability for intent, gross negligence, death or personal injury, or to mandatory consumer rights.
15. Suspension and account deletion
You may stop using the Service and request deletion of your account through the process available in the application or the instructions on the website.
We may temporarily restrict or terminate access in the event of a material or repeated breach of the Terms, a security threat, fraud, a legal requirement or the need to protect other users. Where practicable, we will explain the reason and the available appeal route.
Deleting an account does not always automatically delete all previously published public content. Where appropriate, delete content you control before deleting the account or submit a separate, substantiated request.
16. Changes to these Terms
We may update these Terms. We will notify users of material changes through the Service, by email or by another appropriate method before they take effect where required by law.
The new version applies from the stated date. If you do not agree with the change, stop using the Service and cancel your subscription where applicable.
17. Governing law and disputes
These Terms are governed by the laws of the Republic of Croatia, without prejudice to the mandatory consumer rights provided by the law of the user’s country of habitual residence.
Please contact us first so that we can try to resolve the matter amicably. If the dispute is not resolved, the competent court is determined by applicable law. Consumers may use any out-of-court dispute-resolution mechanism available to them.
